These Terms of Service ("Terms") govern access to and use of Kitchen Stocker, a SaaS platform for inventory management, stock control and food cost analysis for restaurant establishments, available at app.kitchenstocker.com.
The service is provided by Aura Media Consulting S.L., with tax identification number (NIF) B88667829 and registered office at Calle Sagunto 1, Valencia (Valencia), 46009 (hereinafter, "Kitchen Stocker", "we").
By registering for and using the service, the customer ("you") agrees to be bound by these Terms. If you act on behalf of a company, you warrant that you have the authority to accept them.
Kitchen Stocker provides the following functionality, depending on the plan subscribed:
To use the service, you must register with accurate and up-to-date information. You are responsible for maintaining the confidentiality of your credentials and for all activity carried out from your account. You must notify us immediately of any unauthorised access at security@kitchenstocker.com.
Kitchen Stocker offers monthly and annual subscription plans. Current prices are published at /en/pricing. Billing is recurring and is processed automatically on the renewal date. Prices are expressed in euros (€) and include the applicable VAT (IVA) under current Spanish law.
Kitchen Stocker reserves the right to modify prices with a minimum of 30 days' prior notice. If you do not agree with the new price, you may cancel before it takes effect.
New accounts start on the Free plan, with no credit card required and no time limit. The Free plan includes 1 location, 2 users, 100 active items, 20 invoices per month, 10 purchase orders per month and 10 document scans per month; it does not include the CSV import centre or invoice export.
The customer may subscribe to a paid plan at any time in order to extend these limits. If a paid subscription remains unpaid, access is limited until payment is settled. If the subscription is cancelled, the account reverts to the Free plan.
The customer undertakes to use the service in accordance with the law and shall refrain from:
Kitchen Stocker and all of its components (code, design, brand, documentation) are the exclusive property of Kitchen Stocker or its licensors. The customer receives a limited, non-exclusive and non-transferable licence to use the service in accordance with these Terms.
The operational data that the customer enters into the platform (products, recipes, inventories, suppliers) belongs to the customer. Kitchen Stocker claims no ownership rights over it.
Kitchen Stocker strives to maintain service availability above 99,5% per month, excluding scheduled maintenance communicated in advance. We do not guarantee uninterrupted availability in cases of force majeure, third-party infrastructure failures or external attacks.
To the maximum extent permitted by applicable law, Kitchen Stocker shall not be liable for indirect, incidental, special or consequential damages, including loss of profits, loss of data or business interruption, even if advised of the possibility thereof. Kitchen Stocker's total aggregate liability shall not exceed the amount paid by the customer in the 12 months preceding the event giving rise to the claim.
The customer may cancel their subscription at any time from the billing panel. Cancellation takes effect at the end of the current billing period; no refunds are issued for the remaining time except in the case of a verified billing error (see the Refund Policy).
Kitchen Stocker may suspend or terminate access for breach of these Terms, with prior notice except in cases of urgent security concerns.
The processing of personal data is governed by the Privacy Policy and, where applicable, by the Data Processing Agreement (DPA), in accordance with the General Data Protection Regulation (GDPR, "RGPD") and Ley Orgánica 3/2018 (LOPDGDD) (the Spanish Data Protection and Digital Rights Act).
These Terms are governed by Spanish law. For any dispute arising from them, the parties submit to the courts and tribunals of Kitchen Stocker's registered office, unless applicable consumer protection legislation establishes another mandatory jurisdiction.
